Citizen Suits

  • Represented mutual water company as plaintiff in a citizen suit under the Resource Conservation and Recovery Act and Proposition 65 against parties responsible for contaminating company's water supply well
  • Represented municipal wastewater treatment plant in Clean Water Act citizen suit alleging permit violations and unpermitted discharges via wet weather collection system overflows
  • Defending a Proposition 65 citizen suit alleging that our client failed to warn of alleged exposures of lead from decorative paint on glassware. The case settled without significant litigation expenses to our client.
  • Defending a Proposition 65 citizen suit alleging that our client failed to warn of alleged exposures of di(2 ethylhexyl) phthalate (DEPH) from plastic zipper pulls on children's jackets. The case settled without significant litigation expenses to our client.
  • Defending a Proposition 65 citizen suit alleging that our client failed to warn of alleged exposures of lead from brass padlocks and luggage locks. The case settled without significant litigation expenses to our client.
  • Represented manufacturing facility in federal enforcement action and related citizen suit alleging noncompliance with effluent limitations and other permit conditions, including requirements for whole effluent toxicity testing
  • Represented manufacturing facility in Clean Air Act citizen suit alleging noncompliance with National Emission Standards for Hazardous Air Pollutants which had not yet been incorporated into facility's permit
  • Represented engineering firm in Clean Water Act citizen suit alleging unpermitted discharges in violation of applicable water quality standards in connection with implementation of construction project
  • Negotiated consent decrees in CWA citizen suits alleging violations of the storm water industrial general permit by a landfill and by a waste transfer station.
  • Negotiated a consent decree on behalf of a metal recycling facility named as a defendant in a CWA citizen suit; continue to represent facility with respect to consent decree and CWA compliance.
