Environmental Insurance

  • Represented a chemical manufacturer in a suit against its insurers that issued policies over a 40-year period to recover for the cleanup costs at 14 sites nationwide. Achieved settlements sufficient to pay all past and expected future costs as well as attorney's fees in coverage action
  • Represented a major real estate holding company in negotiations with its insurers, and in insurance coverage suits to recover environmental cleanup costs at numerous sites under its policies and under the policies of its tenants
  • Represented a life insurance company in litigation against its insurers for recovery of defense and cleanup costs resulting from a California Regional Water Quality Control Board administrative proceeding
  • Represented a major California university in claims against liability insurers for alleged environmental cleanup liabilities
  • Represented an industrial manufacturer in claims against its liability insurers for alleged contamination of a city's drinking water supply
  • Represented manufacturers in successfully obtaining coverage for lawsuits brought by over 3,000 residents alleging bodily injury and property damage as a result of living in proximity to a state-licensed disposal site
  • Representing a natural gas production company seeking coverage for personal injury and property damage claims arising from natural gas production activities
  • Represented two agricultural companies seeking coverage for personal injury and property damage claims arising from the historic application of agricultural products
  • Negotiated a $100 million remediation stop loss policy and a $50 million pollution legal liability policy for the Presidio Trust with regard to the transfer of the Presidio of San Francisco from the U.S. Department of the Army to the Trust and Department of the Interior.
  • Negotiated a $57 million remediation stop loss policy and a $150 million environmental legal liability, professional liability and contractors pollution legal liability policy with regard to the transfer of the Mare Island Naval Shipyard from the U.S. Department of the Navy.
  • Negotiated a significant cost cap and pollution legal liability policy with regard to the pending transfer of the South Weymouth Navy Air Station in Massachusetts.
  • Negotiated numerous cost cap and pollution legal liability policies for private environmental liability assumption firms and developers and property purchasers with regard to CERLCA, RCRA and other contaminated sites in California, Florida, Michigan, New York, Tennessee, and Wisconsin
  • Negotiated $30 million cost cap and pollution legal liability policies with regard to the transfer of the Oakland Army Base from the U.S. Department of the Navy.
  • Representing landowners in regulatory proceedings concerning a large ranch in the Sacramento Delta area, including site investigation and development of a remedial strategy, creating a fixed-fee site closure plan, and obtaining environmental insurance for unanticipated cleanup costs
  • Represented an oil company in a London arbitration and California litigation seeking coverage from European and Bermuda insurers for a settlement with 13,000 individuals who claimed property damage and bodily injuries from an industrial accident in the United States, recovering more than $55 million in insurance proceeds
