Land Use and Development
The
environmental review requirements of CEQA and NEPA are substantial
challenges for any project that may have significant environmental
impacts, and often for many projects that will not. We are experts
in obtaining approvals and permits for environmentally-related
projects. The firm has counseled corporations, developers, and
public and private institutions in complying with these requirements
and, where necessary, in litigating with government agencies or
citizen groups to obtain such approvals.
Examples
of our representations include:
-
Working with major utilities on project siting and development,
including obtaining all necessary environmental reviews and
approvals
-
Working with clients and the lead and responsible government
agencies to achieve both CEQA compliance and timely processing
of environmental and land use permit applications
-
Review of environmental impact reports and negative declarations
for legal adequacy, and counseling clients to ensure that CEQA
documents and notices are properly prepared
-
Counseling clients with respect to political and electoral
aspects of environmental and land use matters, including
slow-growth measures and the procedural and substantive adequacy
of ballot initiatives and referenda
-
Defending CEQA challenges to a hazardous waste incinerator in
California, based on air impact issues
-
Litigating administrative mandamus actions challenging the
adequacy of CEQA documents for commercial developments
