Barg Coffin Lewis & Trapp, LLP’s insurance coverage practice grew out of our efforts to obtain coverage for our policyholder clients in environmental matters. Over the past 30 years, our practice has expanded and we now represent policyholders in a broad variety of cases. We help policyholders realize the benefits of the coverage available under their insurance policies. We represent policyholders in resolving disputes with their insurers and counsel policyholders on coverage issues in a wide variety of contexts. These include environmental exposures involving both property damage and bodily injury claims, business-related claims, fidelity bond claims, intellectual property claims, employment claims and construction defect matters. We also provide counseling to corporate clients involved in mergers or acquisitions, to assist them either in retaining their insurance rights or in assessing the value of such rights should the client choose to convey or acquire them. We have substantial expertise and experience regarding new insurance products, most recently in the environmental and employment claims areas, which may prove of value to our clients in dealing with future potential liabilities.

Representative Insurance Matters

  • Representing a chemical manufacturer in a suit against its insurers that issued policies over a 40-year period to recover for cleanup costs at 14 sites nationwide. Achieved settlements sufficient to pay all past and expected future costs as well as attorney’s fees in coverage action

  • Representing a major real estate holding company in negotiations with its insurers, and in insurance coverage suits to recover environmental cleanup costs at numerous sites under its policies and under the policies of its tenants

  • Representing a corporation in litigation with its insurers to recover cleanup costs at 25 West Coast sites

  • Representing a life insurance company in litigation against its insurers for recovery of defense and cleanup costs resulting from a California Regional Water Quality Control Board administrative proceeding

  • Representing a major California university in claims against liability insurers for alleged environmental cleanup liabilities

  • Representing an industrial manufacturer in claims against its liability insurers for alleged contamination of a city’s drinking water supply

  • Representing manufacturers in successfully obtaining coverage for lawsuits brought by over 3,000 residents alleging bodily injury and property damage as a result of living in proximity to a state-licensed disposal site

  • Representing a natural gas production company seeking coverage for personal injury and property damage claims arising from natural gas production activities

  • Representing an oil company in a London arbitration and California litigation seeking coverage from European and Bermuda insurers for a settlement with over 14,000 individuals who claimed property damage and bodily injuries from an industrial accident in the United States

  • Representing two agricultural companies seeking coverage for personal injury and property damage claims arising from the historic application of agricultural products

  • Representing a business in successfully obtaining several million dollars in defense costs from its general liability insurer in a business lawsuit, based on coverage for an included claim of defamation
