Environmental Litigation and Enforcement

At Barg Coffin Lewis & Trapp, LLP, our lawyers have been involved in major environmental litigation and enforcement actions for nearly 30 years. We represent clients in litigation brought by local, state and federal government agencies, and by citizen groups. We have successfully litigated many cost recovery lawsuits on behalf of both plaintiffs and defendants, and we are currently involved in both the counseling and litigation aspects of a number of these actions in California as well as other states. We also have defended some of the largest and most complex toxic tort cases in California. 

Our recent matters include:

  • Representing companies in civil penalty actions brought under federal air, water, pesticide, chemical and hazardous waste statutes by the United States Department of Justice on behalf of EPA

  • Representing companies in state and federal Superfund actions brought under CERCLA by EPA and state agencies

  • Representing large oil and other companies in defense of civil penalty “citizen suits” brought by national environmental organizations and alleging non-compliance with permit conditions

  • Representing a major oil company in defense of personal injury, property damage, civil penalty and criminal claims brought by more than 14,000 plaintiffs and government agencies arising from an alleged release of chemicals from a refinery

  • Representing property owners in actions to recover cleanup costs brought against current and former tenants and “generators” including United States military agencies

  • Representing high technology companies in litigation brought against neighboring facilities to force those facilities to perform remedial work and to pay cleanup costs and attorneys’ fees incurred by our clients

  • Representing companies sued as “generators” and seeking recovery of costs related to cleanup of industrial landfills and similar disposal sites

  • Defending numerous individual and mass tort personal injury claims filed in the United States and overseas arising out of alleged exposure to agricultural and industrial chemicals in the workplace, air and groundwater

  • Defending numerous complex property damage claims asserted by individual property owners, municipalities and purported state-wide plaintiff classes arising out of alleged soil and groundwater contamination by agricultural and industrial chemicals
