Representing high technology companies regarding
soil and groundwater remediation programs before state agencies
including the Department of Toxic Substances Control, Regional
Water Quality Control Boards and the State Water Resources
Control Board

Counseling chemical manufacturers regarding the
applicability of the Toxic Substances Control Act to chemical
substances and mixtures, including premanufacture notice
regulations and exemptions, export notification and import
certification, and recordkeeping and reporting requirements

Representing banks and lenders in negotiations
with EPA, the RWQCB, DTSC or local agencies concerning soil and
groundwater contamination

Representing potentially responsible parties,
including landowners, operators, and generators, in consent
decree negotiations with state and federal environmental
agencies

Conducting comprehensive compliance audits for
chemical manufacturers and processors to identify potentially
applicable regulations under TSCA, the Federal Insecticide,
Fungicide and Rodenticide Act, the Emergency Planning and
Community Right-To-Know Act, the California Hazardous Materials
Release Response Plans and Inventory Act, the Occupational
Safety and Health Act and the Clean Water Act pretreatment
program

Representing hazardous waste and solid waste
disposal companies in modifying or obtaining permits and
variances from local, state and federal regulatory agencies
under applicable waste laws

Representing companies as coordinating counsel
and directing the work of other professionals, such as
engineers, architects, industrial hygienists, lawyers and
asbestos consultants

Representing companies subject to multi-media
investigations by local, state and federal agencies
-
Counseling chemical manufacturers regarding
compliance with OSHA and Cal/OSHA’s Hazard Communication
Standard, including requirements relating to hazard assessment,
product labeling, Material Safety Data Sheets, hazard
communication planning and employee training

Representing companies in obtaining National
Pollutant Discharge Elimination System (NPDES), storm water and
related discharge permits

Representing companies in obtaining reimbursement
from state or federal operated funds for removal of underground
tanks or performance of similar clean up work

Counseling chemical companies regarding
compliance with Toxic Substances Control Act requirements,
including premanufacture notice and significant new use rules,
Section 4 Test Rules and consent orders, Inventory Update Rule
reporting, Preliminary Assessment Information Rule reporting,
chemical-specific reporting and recordkeeping, import
certification and export notification

Counseling chemical manufacturers regarding
labeling regulations, reporting obligations, and emergency
planning requirements under federal and state laws including
EPCRA, California Proposition 65, California occupational safety
and health regulations, the California Inventory Act, RCRA and
the California Hazardous Waste Control Law
